Fettes Sawmill Ltd – Terms and Conditions – July 2023

Order Cancellation – the Purchaser shall, within 7 days of payment of a deposit, be entitled, by written notice to the Company,
to cancel the purchase in which event the Purchaser shall be entitled to a refund of monies paid, less any administration or
other costs. Deposits will not be refunded on bespoke or nonstock buildings after the seven-day cut off.

Cancellation of Contract – As a consumer, you automatically get a 14 day ‘cooling off period’ when you buy something that you
haven’t seen in person – unless the item is made to your personal specifications (ie. Custom made or made to measure). Your
14-day cooling off period commences as soon as your order is received either at your own address or an alternative address
specified by you. There does not need to be anything wrong with the item in order for you to cancel your order and receive a full
refund. If your order consists of multiple goods, the 14-day cooling off period runs from when your get the last of the batch.
Once you have informed that you wish to cancel your order you have a further 14 days in which to arrange for the goods to be
returned to our premises: Fettes Sawmill, Killearnan, Muir of Ord, IV6 7RT. If you wish to cancel, please contact us immediately
by e-mail at: sales@fettessawmill.co.uk. Alternatively, you can fill in a cancellation form which can be found on our website or
requested by e-mail.

Pricing & Description of Products – Fettes Sawmill Ltd take all reasonable care in the preparation of the content of our pricelists
and our website, in particular to ensure that details, descriptions and prices of products on Fettes Sawmill’s pricelists and
website are correct at time of publishing and all products have been fairly described. Although we aim to keep our pricelists and
website as up to date as possible, the information including product descriptions or price appearing on our pricelists and website
at a particular time may not always reflect the position exactly at the moment you place an order. In the event of a product’s
correct price being higher than the price stated on our pricelist or site, we will at our discretion either contact you for
instructions before dispatching the product, or reject your order and notify you of such rejection. We are under no obligation to
provide the product to you at the incorrect (lower) price, even after we have sent you an order confirmation e-mail. We cannot
confirm the price of a product until your order is accepted in accordance with our payment procedure detailed above. Any order
is only accepted at the point when your product is despatched. All sizes quoted are approximate. Fettes Sawmill Ltd shall not be
liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the
materials on this website.

Materials & Warranty – All our Lugarde and Woodpro Buildings come with a 5-year manufacturer’s warranty to replace
damaged or defective parts. Lugarde and Woodpro’s terms and conditions are sent along with your deposit pack and are
available upon request and can be found here – https://www.lugarde.com/terms-conditions/. Doors and windows sticking is
not classed as damaged or defective, for the most part this is caused by natural movement of the timber. As this is a natural
occurrence this will be covered for 3 months following the date of installation and no more. Upon completion of the
installation, you will be shown how to adjust to hinges to rectify this issue. Damage caused by humans, animals or natural
disasters does not fall under the warranty. High winds CAN cause damage to buildings which is unpreventable, there is no
guarantee provided in circumstances wind damage occurs. Precautions such as our storm kit can be put in place however this
does not provide any guarantee that wind damage will not occur however it will reduce the risk.
Fettes have a minimum callout fee of £50.00 + VAT locally, £100.00 + VAT for further afield for any issues/concerns you have
with your building. If the cause deems to be a manufacturing fault the callout fee will be refunded. This doesn’t include any
additional costs such as parts and labour.

Fettes Garden Buildings do not come with a warranty. Customers are advised that although Fettes made buildings are Pressure
Treated against rot and infestation, this DOES NOT make the building waterproof and a recognised product must be used to
waterproof the building. PLEASE NOTE: We do NOT recommend Cuprinol! Be advised that our own buildings may come to you wet as Fettes do not have the facilities to store the
buildings inside whilst waiting to be delivered or collected. Complaints as a result of poorly laid foundations or faulty assembly,
poor maintenance and/or the wrong maintenance materials do not fall under the warranty. The buildings must be sealed inside
and out with a suitable waterproof product. Some movement of the timber may occur as it expands and contracts with changes
in humidity and temperature, knots may also fall out, this is perfectly natural and does not affect the integrity of the product
and is not classed as damage. N.B. Proof of purchase must be shown for any warranties, refunds or sales issues.

Movement of the timber – A wooden summerhouse or log cabin expands or contracts depending on humidity levels. This is a
normal feature of wood. Wood expands, but doesn’t get longer. Every plank expands by around 1.5mm. Since every
summerhouse is around 15 planks high, this amounts to a full expansion of around 2.25 cm (15 x 1.5 mm).
Liabilities – It is the sole responsibility of the customer to obtain planning consent or make any necessary enquiries to their local
planning department for any product supplied by Fettes Sawmill Limited. Loss or damage arising from fair wear and tear, wilful
damage, storm damage, negligence on the part of the customer, or failure to follow appropriate maintenance instructions, is not
the liability of Fettes Sawmill Limited. Wood is a natural material affected by environmental and climatic changes. Fettes Sawmill
Limited cannot accept liability for splits, shrinkage, expansion, warping, variations in colour and other natural imperfections. All
sizes and measurements stated must be regarded as approximate.

Delivery – Our local deliveries are to the roadside only unless agreed upon prior to delivery taking place. The goods will be
delivered to the most accessible and convenient location the driver can find otherwise. There must be at least two able persons
to help offload. Charges will apply if this is not the case. Delivery charges and estimated timescales for delivery are calculated
when you place your order. We make every effort to deliver items within the estimated timescale, however delays are
occasionally inevitable due to unforeseen factors. Fettes Sawmill Ltd shall have no liability for any delay or failure to deliver the
products within our estimated timescales. We recommend that you do not book installers until your order has been delivered to
you and checked. Fettes Sawmill Ltd cannot be held responsible for any third-party costs incurred due to non-delivery of an
order. We reserve the right to charge for delivery in the event that incorrect information is provided by the customer to Fettes
Sawmill Ltd resulting in a redelivery of your order. We will deliver the goods ordered by you to the address you give us for
delivery at the time you make your order. Risk of loss and damage of products passes to you on the date the products are
delivered or on the date of first attempted delivery by us. Our deliveries are for the UK mainland only, we are not able to deliver
to offshore locations.

Installation of Product & Maintenance – You must ensure that you have received and checked your order in full before booking
any fitters or contractors. Any issues must be reported to Fettes Sawmill Ltd within 7 days of delivery. Fettes Sawmill Ltd will
not be liable for any financial losses or claims (including without limitation loss of revenues, data, profits, expenses, contracts,
business or anticipated savings); or loss of goodwill or reputation; or special or indirect losses due to any fitters and contractors
unable to continue installation as a result of missing, damaged, non-delivery or incomplete delivery of goods ordered from
Fettes Sawmill Ltd. You must paint your garden building as soon as possible, inside and out, and then regularly with a good
quality waterproof paint to preserve the integrity of the garden building. Note: FETTES does not guarantee any third party
contracted work, liability is held by the contractor.

Please note: Timber is not waterproof! After any storm it is necessary to check the roof structure and make any necessary
repairs. We would strongly advise fitting guttering and down pipes to a suitable outflow to avoid water hitting the ground and
bouncing back up onto the garden building. This could lead to damp problems or water damage and may also undermine the
foundations of your building.

Site Preparation & Prices – The type of base needed for install will depend in the type of garden building. Sheds, stick shed,
greenhouses and Fettes built garages can be placed on either a concrete or slab base. BBQ huts can be placed on either a
decking or concrete base. Lugarde and Woodpro structures are strongly recommended to be installed onto a 100mm thick
concrete base which is underlined by a dampproof membrane that is made to the size of the structure, anything outside of this
recommended base will be subject to a base disclaimer that is available to view upon request. The customer should be aware
that fixing a building/structure to a slab base may cause the slabs to crack, for this Fettes takes no responsibility. The base must
be flat, level and fit for purpose. The Fettes installation team reserves the right to refuse installation if the base is not
appropriate for the building and if the building’s structural integrity would be affected as a result. If the base is unsuitable, the
building will be left with the customer until the issues have been rectified. It will then become the responsibility of the customer
to store the building. Fettes WILL NOT remove goods after attempted installation and the outstanding balance for the building
MUST be paid in full on the day of the original install. If a base is deemed unfit for purpose there will be a minimum charge
(subject to distance travelled and days booked) of £450.00+VAT as we will have lost a minimum of one day for any other work to
be completed. We will endeavour to install the building at a later date, convenient to ourselves and the customer.

Payment Terms & Invoicing – Fettes sheds and garages must be paid in full on ordering. Lugarde/Woodpro Buildings and
Swallow Greenhouses require a 50% deposit payable in advance on ordering. If the building is subject to a deposit, then the final
balance must be cleared in good time prior to the delivery. If the garden building is to be installed by Fettes Sawmill Ltd, full
payment is due on the day the garden building is installed. We will not be held liable for missing parts or damage parts caused
by any manufacturer; it will not be reason accepted as a reason for non-payment unless otherwise agreed.
If the final balance is withheld, Fettes has the right to keep the keys for the building until full payment is received.
N.B. Cheques are no longer accepted. Our credit card limit per purchase is £2000. We do not offer any finance or credit
arrangements. Title to the product and guarantee remain the property of Fettes Sawmill Ltd until paid in full. These Terms and
Conditions do not affect your statutory rights.
